Rakuten Viber Dating Giveaway Terms and Conditions

Drago nam je što želite da učestvujete u promotivnoj kampanji “Rakuten Viber Dating” (u daljem tekstu: “Promocija”). Ovi uslovi i odredbe (u daljem tekstu: “Uslovi”) regulišu vaše učešće u Promociji, dok Uslovi i odredbe Rakuten Viber Dating platforme regulišu kreiranje i upravljanje vašim profilom (kako je definisano u nastavku). Učestvovanjem u Promociji i kreiranjem profila, saglasni ste da budete obavezani ovim Uslovima, te vas molimo da ih pažljivo pročitate. Ukoliko se ne slažete sa ovim Uslovima, molimo vas da se uzdržite od učešća u Promociji. Pod pojmom “Rakuten Viber” podrazumeva se kompanija Viber Media S.à.r.l., registrovana u Velikom Vojvodstvu Luksemburg, sa sedištem na adresi 2 rue du Fossé, L-1536 Luksemburg.

1. Opšte odredbe

1.1. Tokom trajanja Promocije (kako je definisano u nastavku), korisnici aplikacije Rakuten Viber koji ispunjavaju kriterijume podobnosti mogu učestvovati u Promociji i imati priliku da osvoje Nagradu (kako je ovaj pojam definisan u nastavku) (svaki takav korisnik dalje u tekstu: “Učesnik” ili “vi”).

1.2. Rakuten Viber ne preuzima odgovornost za prijave koje nisu primljene na vreme ili uopšte, iz bilo kog razloga, uključujući tehničke greške ili kvarove.

2. Podobnost

2.1. Promocija je otvorena za rezidente Srbije i Bosne i Hercegovine (u daljem tekstu: “Zemlje učesnice”), koji su stariji od 18 godina u trenutku trajanja Promocije i koji su do 31. marta 2025. godine u 23:59 UTC (GMT+0) ispunili sve sledeće korake:

2.1.1. Ili: 

2.1.1.1. Otvorili Rakuten Viber Dating profil (u daljem tekstu: “Profil”) - što podrazumeva ispunjavanje svih relevantnih zahteva za registraciju (npr. ime, datum rođenja, postavljanje najmanje dve fotografije itd.) i ostvarili najmanje jedno (1) “povezivanje” (“match”) sa drugim korisnikom Rakuten Viber Dating platforme; 

ili, ukoliko već imaju Profil tokom trajanja Promocije

2.1.1.2. Kupili najmanje jedan paket koji sadrži 5 ”MegaLajkova” i ostvarili najmanje jedno (1) “povezivanje” (“match”) sa drugim korisnikom Rakuten Viber Dating platforme; 

2.1.2. Korisnici koji nisu identifikovani putem internih sistema Rakuten Vibera kao prevaranti ili spameri (u kom slučaju će im biti onemogućeno učešće u Promociji i biće diskvalifikovani). 

2.2. Učestvovanjem u Promociji, obavezujete se:

2.2.1. da poštujete ove Uslove i sve važeće zakone (uključujući zakone Zemalja učesnica); i

2.2.2. da ne vršite prevaru i/ili bilo kakvu drugu zloupotrebu, kako je dalje navedeno u odeljku 2.3 u nastavku.

2.3. Rakuten Viber može odmah ukinuti vaše pravo na Nagradu, zabraniti vam učešće u Promociji ili osvajanje Nagrade (ili preduzeti bilo koju drugu radnju koju smatra odgovarajućom), uključujući i slučaj kada je Promocija već započela i kada ste proglašeni “Pobednikom”, ako prema sopstvenom nahođenju utvrdi da pokušavate da ugrozite zakonito sprovođenje Promocije putem prevare, varanja, hakovanja, obmane, drugih nepoštenih praksi ili ako ne postupate u skladu sa važećim uslovima Rakuten Vibera ili relevantnim zakonima koji se odnose na Promociju.

2.4. Ukoliko iz bilo kog razloga ne uspešno prođete internu verifikaciju Rakuten Vibera (koja je osmišljena da proveri usklađenost sa uslovima i politikama Rakuten Vibera), nećete moći da osvojite i/ili preuzmete Nagradu.

3. Nagrada

3.1. Od svih Učesnika koji su podneli prijavu i koji su proglašeni podobnim u skladu sa ovim Uslovima, jedan (1) Učesnik biće izabran da osvoji vaučer za putovanje za dvoje u jednoj od predviđenih smeštajnih jedinica (u daljem tekstu: “Pobednik”, “Nagrada” i “Smeštaj”). 

3.2. Ukoliko budete proglašeni Pobednikom, potrebno je da potvrdite osvajanje Nagrade odgovarajući na poruku upućenu putem komunikacionog kanala koji je koristio Rakuten Viber (kako je detaljno opisano u Odeljku 5 u nastavku). U suprotnom, Nagrada će biti izgubljena i nećete imati pravo da je primite.

3.3. Rakuten Viber zadržava pravo da u bilo kom trenutku izmeni, prilagodi, suspenduje i/ili otkaže Promociju ili bilo koji njen deo (uključujući promenu datuma trajanja Promocije ili njeno potpuno ukidanje). Takođe, Rakuten Viber zadržava pravo da izmeni listu Smeštaja, prekine saradnju sa Agencijom (kako je definisano u nastavku), promeni vrednost Nagrade, trajanje Nagrade, kriterijume za osvajanje Nagrade ili da u potpunosti otkaže dodelu Nagrade – sve to bez prethodne najave Učesnicima, po sopstvenom nahođenju i bez ikakve odgovornosti sa svoje strane. Sve odluke Rakuten Vibera u vezi sa Promocijom i Nagradom su konačne i obavezujuće.

3.4. Pobednik snosi isključivu odgovornost za sve poreze ili druge fiskalne obaveze koje mogu nastati kao posledica primanja Nagrade.

3.5. Pobednik je isključivo odgovoran za kontaktiranje Agencije i rezervisanje Nagrade (kako je detaljno opisano u Odeljku 4 u nastavku).

3.6. Svi rezultati Promocije su konačni i ne podležu nikakvom vidu žalbe ili preispitivanja.

4. Postupak preuzimanja Nagrade

4.1. Rakuten Viber će kontaktirati Pobednika putem Rakuten Viber platforme kako bi ga obavestio o osvojenoj Nagradi. 

4.2. Pobednik je dužan da potvrdi osvajanje Nagrade odgovarajući na poruku u roku od 48 sati od trenutka njenog prijema.

4.3. Ukoliko Pobednik ne odgovori na poruku Rakuten Vibera u predviđenom roku, gubi pravo na preuzimanje Nagrade i više neće imati pravo da je primi.

Nakon što Pobednik potvrdi osvajanje Nagrade, Rakuten Viber će mu dostaviti dodatne informacije o načinu realizacije Nagrade, uključujući kontakt sa određenom turističkom agencijom (u daljem tekstu: “Agencija”), koja će pružiti detalje o Smeštaju, vremenskom okviru za korišćenje Nagrade i druge relevantne informacije.

5. Trajanje Promocije

5.1. Promocija počinje 17. marta 2025. godine i trajaće 15 dana, zaključno sa 31. martom 2025. godine u 23:59 UTC (GMT+0) (u daljem tekstu: “Trajanje”).

5.2. Pobednik se obavezuje da neće obrisati aplikaciju Rakuten Viber, svoj Rakuten Viber nalog niti svoj Profil tokom Trajanja Promocije i 30 dana nakon njenog završetka, u suprotnom će izgubiti pravo na Nagradu.

6. Ograničenje odgovornosti; Odsustvo garancije

6.1. U NAJVEĆOJ MERI DOZVOLJENOJ VAŽEĆIM ZAKONOM, RAKUTEN VIBER, NJEGOVE POVEZANE KOMPANIJE, KAO I NJIHOVI DIREKTORI, SLUŽBENICI, ZAPOSLENI, SLUŽBENICI ILI AGENTI, NEĆE BITI ODGOVORNI ZA BILO KAKVU ŠTETU ILI GUBITKE BILO KOJE VRSTE, UKLJUČUJUĆI DIREKTNU, INDIREKTNU, POSEBNU, SLUČAJNU, POSLEDIČNU ILI PRIMERNU ŠTETU PROISTEKLU IZ VAŠEG UČEŠĆA U PROMOCIJI ILI BILO KOJEG DRUGOG ZAHTEVA KOJI SE NA BILO KOJI NAČIN ODNOSI NA PROMOCIJU. OVA IZUZIMANJA UKLJUČUJU, BEZ OGRANIČENJA, ŠTETU ZBOG IZGUBLJENE DOBITI, GUBITKA PODATAKA, GUBITKA DOBRE VOLJE, PREKIDA RADA, KVARA ILI NEISPRAVNOSTI RAČUNARA ILI BILO KOJE DRUGE POSLOVNE ŠTETE ILI GUBITKE, ČAK I AKO JE RAKUTEN VIBER BIO OBAVEŠTEN O MOGUĆNOSTI NASTANKA TAKVE ŠTETE, BEZ OBZIRA NA PRAVNI ILI PRAVIČNI OSNOV NA KOJEM SE ZAHTEV TEMELJI.

6.2. SVE ŠTO SE NALAZI NA RAKUTEN VIBER PLATFORMI DOSTUPNO JE “TAKVO KAKVO JESTE” BEZ BILO KAKVE IZRIČITE ILI PODRAZUMEVANE GARANCIJE. UČESNICI SE SLAŽU I POTVRĐUJU DA SE NAGRADA DODELJUJE “TAKVA KAKVA JESTE” BEZ BILO KAKVIH GARANCIJA, PREDSTAVLJANJA ILI OSIGURANJA, IZRIČITIH ILI PODRAZUMEVANIH, BILO U ČINJENICAMA ILI PO ZAKONU, KOJE SE ODNOSE NA NJENO KORIŠĆENJE ILI ISKORIŠĆAVANJE. RAKUTEN VIBER NE SNOSI ODGOVORNOST ZA BILO KAKVE DODATNE TROŠKOVE, PROPUSTE, KAŠNJENJA ILI PROMENE PUTANJE KOJE PROISTIČU IZ POSTUPAKA BILO KOJE VLADE ILI NADLEŽNOG ORGANA. 

6.3. UČESTVUJUĆI U PROMOCIJI, OVIM PUTEM OSLOBAĐATE RAKUTEN VIBER, NJEGOVE POVEZANE KOMPANIJE I PODSIDIJARE, KAO I NJIHOVE DIREKTORE, SLUŽBENIKE, ZAPOSLENE, IZVOĐAČE RADOVA ILI AGENTE, U NAJVEĆOJ MERI DOZVOLJENOJ BILO KOJIM VAŽEĆIM ZAKONOM, OD BILO KAKVE ODGOVORNOSTI, GUBITAKA, ZAHTEVA, TUŽBI ILI RADNJI BILO KOJE VRSTE KOJE SE ODNOSE NA POVREDE, ŠTETU ILI GUBITKE LJUDI ILI IMOVINE, KOJI MOGU NASTATI U VEZI SA: PODNOŠENJEM PRIJAVE ZA PROMOCIJU, NAGRADOM, UČEŠĆEM U PROMOCIJI ILI BILO KOJIM ASPEKTOM PROMOCIJE.

7. Ostale odredbe

7.1. Ova Promocija i ovi Uslovi uređuju se zakonima Engleske i Velsa, bez obzira na načela sukoba zakona. Kao uslov za učestvovanje u ovoj Promociji, saglasni ste da će se svi sporovi koji ne mogu biti rešeni između strana, kao i pravni postupci koji proizlaze iz ove Promocije ili su s njom povezani, rešavati pojedinačno, bez pribegavanja bilo kakvoj kolektivnoj tužbi, isključivo pred sudom u Londonu, Velika Britanija. Nadalje, u bilo kojem takvom sporu, ni pod kojim okolnostima nećete imati pravo na dodelu odštete za kaznene, slučajne ili posledične štete, uključujući advokatske troškove, te se ovim putem odričete svih prava na takve zahteve. OVA PROMOCIJA JE NIŠTAVA TAMO GDE JE ZABRANJENA ILI OGRANIČENA ZAKONOM.

7.2. U slučaju bilo kakve nedoslednosti između ovih Uslova i bilo kojih njihovih dodataka ili aneksa, ovi Uslovi će imati prednost i primenjivaće se.

7.3. Učestvovanjem u Promociji potvrđujete da ste pročitali i prihvatili ove Uslove i dajete izričitu saglasnost Rakuten Viberu da prikuplja i obrađuje vaše lične podatke u svrhe navedene u ovim Uslovima. Rakuten Viber će obrađivati sve lične podatke u skladu sa svojom Politikom privatnosti, koja je dostupna ovde and ovde.

We are happy that you wish to take part in the “Rakuten Viber Dating Promotion campaign” (the “Promotion”). The terms and conditions set out here (the “Terms”) govern your participation in the Promotion, and the Rakuten Viber Dating Terms and Conditions govern the creation and management of your Profile (as defined below). By participating in the Promotion and creating a Profile, you agree to be bound by these Terms, so please read these Terms carefully. If you do not agree to be bound by these Terms, you should refrain from participating in the Promotion. “Rakuten Viber” means Viber Media S.à.r.l., a company incorporated in the Grand Duchy of Luxembourg, having offices at 2 rue du Fossé, L-1536 Luxembourg.

1. General

1.1. During the Term (as defined below) of the Promotion, users of the Rakuten Viber App that fulfill the eligibility criteria can participate in the Promotion and have the opportunity to win a Reward (as this term is defined below) (any such user, a “Participant”, or “you”).

1.2. Rakuten Viber assumes no responsibility for entries not received on time or at all for whichever reason, including due to a technical error or malfunction.

2. Eligibility

2.1. The Promotion shall be open to residents of Serbia and Bosnia & Herzegovina (the “Participating Countries”), who are 18 or over at the time of the Promotion and who have completed all of the following steps by March 31, 2025, 23:59 UTC (GMT+0):

2.1.1. Either:

2.1.1.1. Opened a Rakuten Viber Dating Profile (the “Profile”) — which includes completion of all applicable registration requirements (i.e., name, birthdate, uploaded at least 2 photos etc.), and had at least one (1) “match” with another Rakuten Viber dating user;

Or, if already have a Profile during the Term

2.1.1.2. Purchased at least one pack consisting of 5 “MegaLikes”, and had at least one (1) “match” with another Rakuten Viber dating user;

2.1.2. Who are not identified by Rakuten Viber internal systems as fraudsters or spammers (in which case the user will be restricted from, and ineligible for, participation in the Promotion hereunder).

2.2. Whilst participating in the Promotion you undertake:

2.2.1. to comply with the requirements of these Terms and any applicable law (including the laws of the Participating Countries); and

2.2.2. not to commit fraud and/or any other misuse, as further set in Section 2.3 below.

2.3. Rakuten Viber may immediately terminate your entitlement for the Reward, prohibit you from participating in the Promotion or winning the Reward (or any other action it deems appropriate), including if the Promotion has already commenced, and you were declared a “Winner” if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Promotion by fraud, cheating, hacking, deception, other unfair practice or are in non-compliance with applicable Rakuten Viber terms or applicable law relevant to the Promotion.

2.4. If you are unable to pass Rakuten Viber’s internal verification process (designed to verify compliance with Rakuten Viber’s terms and policies) for any reason, you will not be able to win and/or claim the Reward.

3. Reward

3.1. Of all Participants who submitted an entry, and are deemed eligible according to these Terms, one (1) will be chosen to win a voucher for a couple’s weekend getaway, at the participating accommodations (the “Winner”, the “Reward”, and the “Accommodations” respectively).

3.2. If you are a Winner, you will need to claim your victory by responding to the communication method Rakuten Viber approached you (as further detailed in Section 5 below) otherwise the Reward will be forfeited, and you will not be entitled to receive it.

3.3. Rakuten Viber reserves the right to change, modify, suspend and/or cancel the Promotion or any part thereof at any time (including by way of changing the Promotion dates or discontinue this Promotion at any time). Rakuten Viber further reserves the right to change the list of Accommodations, cease engagement with the Agency (as defined below),change the Reward value, change the duration of the Reward, change the criteria for winning the Reward, or cancel the Reward, all without notice to Participant, at Rakuten Viber’s sole discretion, and without any liability on its part. Rakuten Viber’s decisions on all matters involving the Promotion and the Reward will be final and binding.

3.4. The Winner is solely responsible for handling any tax obligations that apply to the Reward as a result of its claiming.

3.5. The Winner is solely responsible for contacting the Agency, and booking the Reward (as further detailed within Section 4 below).

3.6. All results of the Promotion shall be final and not subject to any type of appeal.

4. Procedure for Receiving a Reward

4.1. Rakuten Viber will contact the Winner via Rakuten Viber platform to inform them about winning the Reward.

4.2. The Winner will need to claim the victory by responding to such communication method within 48 hours following its receipt.

4.3. If the Winner does not respond to the Rakuten Viber’s communication memo within the time frame to do so, the Winner will lose his/her eligibility to claim the Reward and will not be entitled to receive it anymore.

Following Winner’s claiming of the victory, Rakuten Viber will provide the Winner with further details on how to carry out the Reward, including by contacting a designated travel agency (the “Agency”), which will provide further details regarding the Accommodations, the timeframe to execute the Reward, etc.

5. Promotion Term

5.1. The Promotion shall commence on March 17, 2025 for a period of 15 days (until March 31, 2025, 23:59 UTC (GMT+0)) (the “Term”).

5.2. The Winner undertakes not to delete the Rakuten Viber app, his Rakuten Viber account nor his Profile during the Term and 30 days thereafter, otherwise he will lose his eligibility for the Reward.

6. Limitation of Liability; No Warranty

6.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAKUTEN VIBER AND EACH OF ITS AFFILIATES, AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE ARISING FROM YOUR PARTICIPATION IN THE PROMOTION OR ANY OTHER CLAIM RELATED IN ANY WAY TO THE PROMOTION. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF RAKUTEN VIBER HAD BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED.

6.2. EVERYTHING ON RAKUTEN VIBER IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. PARTICIPANTS AGREE AND ACKNOWLEDGE THAT THE REWARD IS PROVIDED “AS IS” WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR UTILIZATION OF THE REWARD, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.

6.3. BY PARTICIPATION IN THE PROMOTION, YOU HEREBY RELEASE RAKUTEN VIBER AND EACH OF ITS AFFILIATES AND SUBSIDIARIES AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS, TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAW, FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS OR ACTIONS OF ANY KIND WHATSOEVER WITH RESPECT TO INJURIES, DAMAGES, OR LOSSES, TO PERSONS OR PROPERTY, WHICH MAY BE SUSTAINED IN CONNECTION WITH THE: SUBMITTING OF AN ENTRY TO THE PROMOTION, THE REWARD, THE PARTICIPATION IN THE PROMOTION OR WITH RESPECT OF ANY ASPECT OF THE PROMOTION.

7. Miscellaneous

7.1. The Promotion and these Terms are governed by the laws of England and Wales, without regard to the conflict of laws principles. As a condition of participating in this Promotion, you agree that any and all disputes which cannot be resolved between the parties hereto, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in London, UK. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, or consequential damages, including attorneys’ fees. THIS PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

7.2. In the event of any inconsistency between these Terms and any or its ancillaries and annexes, these Terms shall prevail and govern.

7.3. By participating in the Promotion, you confirm that you have read and agreed to these Terms and grant Rakuten Viber explicit consent to collect and process your personal data for the purposes specified in these Terms.
