Viber Pay 2-Sided Referral Terms and Conditions 

We are happy that you wish to take part in the Viber Pay 2-Sided Referral promotion (the "Promotion").

These terms & conditions (the "Terms") govern your participation in the Promotion. By participating in the Promotion, you agree to be bound by these Terms, so please read these Terms carefully. If you do not agree to be bound by these Terms, you should refrain from participating in the Promotion. "Viber" means Viber Media S.à r.l., a company incorporated in the Grand Duchy of Luxembourg, having offices at 2 rue du Fossé, L-1536 Luxembourg.

Participants. In order to be eligible for the Promotion, you (or the “Referrer”) must have an active Viber Pay account, and have the Viber App on your mobile device. In order to take part in the Promotion you must share your unique link with someone else (the “Recipient”).


1. General Promotion

1.1. In order to take part in the Promotion you must meet the following Viber eligibility criteria:

1.1.1. be a resident of the country in which the Promotion takes place and be at least 18 years of age at the time of the relevant Promotion and during the Term; and

1.1.2. who are not identified by Viber internal data security systems as fraudsters or spammers (in which case the user will be restricted from, and ineligible for, participation hereunder).

1.2. Viber may prohibit you or a Recipient from participating in the Promotion or winning a Reward (or any other action it deems appropriate) if, in its sole discretion, it determines that you or a Recipient are attempting to undermine the legitimate operation of the Promotion by fraud, cheating, hacking, deception, other unfair practice or are in noncompliance with applicable Viber terms or applicable law relevant to the Promotion. You/ the Recipient must complete all steps required and pass all eligibility criteria to receive a Reward. If you are unable to do so for any reason within 45 days after the notification mentioned in 1.1.7. you / the Recipient will lose the right to a Reward.

1.3. Viber may, at its sole discretion, and at any time i. cancel any outstanding Reward granted (or any part thereof), or ii. require you or the Recipient to repay the amount corresponding to the reward value (or any overpayment), or iii. recover the amount corresponding to the reward value (or any overpayment), if the Reward (or any part thereof) is granted: i. in contravention to these Terms, ii. any applicable law, or iii. in error.


2. The Promotion:

2.1 In order to take part in the Promotion you must share your unique link to the Recipient. The Recipient need not be on Viber at the time of sharing but they must:

2.1.1. meet Viber’s eligibility criteria;

2.1. 2 click your link;

2.1. 2 either already be a member of Viber or join Viber;

2.1.3 be in a country where Viber Pay is available and join Viber Pay (i.e. they cannot be current members of Viber Pay or have joined previously). The Recipient will be required to pass onboarding and either standard or enhanced verification. If they are unable to do so for any reason neither you nor the Recipient will be able to claim a Reward (as described below);

2.1.4 having joined Viber Pay top up the required amount by card as displayed on the referral screen;

2.1.5 all of these steps must be performed by the Recipient within 7 days from agreeing to participate and before the end of the Term (if the Recipient has already begun performance and Viber terminates the Promotion the Recipient will still be able to complete within the 7 day period) (the “Reward Requirements”). Both you and the Recipient will lose the right to a Reward if the Recipient is unable to comply with the Reward Requirements for any reason;

2.1.6 If the above steps, these Terms and all other applicable terms are complied with, both you and the Recipient will receive a reward. You will receive the monetary value to your Viber Pay account as a reward (the “Reward”) The Reward is subject to your available balance limit, so, if you have already reached your available balance you will be required to undertake enhanced verification before you can receive your Reward.

2.1.7. If you have not updated your Viber application to the latest version you and the Recipient will get a Reward of a monetary value of €4 and up to a maximum €100 per month each.

2.1.8. If you have updated your Viber application to the latest version you will get to spin the wheel of fortune in Viber Pay, which will result in a monetary reward. The Reward for both you and the Recipient will be chosen separately and may not be the same. The monetary value of the reward each of you will win, will be selected randomly from the values visible on the spinning wheel, in accordance with the below table. The maximum reward value you can get on a calendar monthly basis will depend on how many spins of the wheel you win. The maximum limit of spins you can win in a month is indicated in the Viber Pay Referral screen. If you exceed this, you can still refer people but you will not receive a Reward. The Recipient may still obtain a Reward if stated in the Viber Pay referral screen.

2.2 Both you and the Recipient will receive a notification when the Reward is paid.

2.3 Note, a Recipient can only be paid once for joining Viber Pay under a referral campaign.

2.5 Viber may prohibit you or a Recipient from participating in the Promotion or winning a Reward (or any other action it deems appropriate) if, in its sole discretion, it determines that you or a Recipient are attempting to undermine the legitimate operation of the Promotion by fraud, cheating, hacking, deception, other unfair practice or are in non compliance with applicable Viber terms or applicable law relevant to the Promotion. You/ the Recipient must complete all steps required and pass all eligibility criteria to receive a Reward. If you are unable to do so for any reason within 45 days after the notification mentioned in 1.1.7. you / the Recipient will lose the right to a Reward.

2.6 The Promotion shall take place from (start date) until terminated by us (the “Term”).

2.7 Viber may, at its sole discretion, and at any time i. cancel any outstanding Reward granted (or any part thereof), or ii. require you or the Recipient to repay the amount corresponding to the reward value (or any overpayment), or iii. recover the amount corresponding to the reward value (or any overpayment) , if the Reward (or any part thereof) is granted: i. in contravention to these Terms, ii. any applicable law, or iii. in error.


3. Limitation of Liability:

3.1 VIBER AND EACH OF ITS AFFILIATES, AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE ARISING FROM YOUR PARTICIPATION IN THE PROMOTION INCLUDING ANY CLAIM RELATED TO THE REWARDS. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF VIBER HAD BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, VIBER'S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

3.2 AS A CONDITION OF YOUR PARTICIPATION IN THE PROMOTION, YOU AGREE TO RELEASE VIBER AND EACH OF ITS AFFILIATES, AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DAMAGES, OR LOSSES TO PERSONS OR PROPERTY WHICH MAY BE SUSTAINED IN CONNECTION WITH SUBMITTING AN ENTRY OR OTHERWISE PARTICIPATING IN ANY ASPECT OF THE PROMOTION;


4. General.

4.1 Viber reserves the right to change the Promotion or any part thereof and these Terms (including the Reward Requirements and a Reward.), or discontinue this Promotion at any time without notice, at Viber's sole discretion, and without any liability on its part. Viber’s decisions on all matters involving the Promotion will be final.

4.2 The winner of a Prize is solely responsible for handling any tax obligations that apply to it as a result of receipt of a Prize.

4.3 The Promotion and these Terms will be governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts located in England and Wales.

4.4 These Terms are offered in Greek and in English, in the case of any conflict the Greek terms shall prevail.
